The new Health Information Technology for Economic and Clinical Health Act or HITECH Act, contained within the American Recovery and Reinvestment Act of 2009 (ARRA) and signed into law on February 17, 2009, sets new standards for management of electronic medical records (EMR). It requires healthcare organizations to comply with new IT security breach notification rules regarding the unauthorized disclosure of protected health information (PHI). Failure in safeguarding data, resulting in exposure of PHI after September 18, 2009, could subject organizations to civil and/or criminal penalties in the event of a data breach.
